Terms of User Agreement

HONGKONG Anycubic Technology CO.,Ltd (“Anycubic” or Makeronline or ”we” or “us”) reminds you (or “User”) to read the following terms and conditions (“Terms”) carefully before you agree this Agreement, especially the disclaimers that exclude or limit Makeronline’s liabilities and limitation on your rights. If you don’t agree this Agreement, you shall immediately stop registering or using the service. By accessing the Site or any of the services provided to you through the Site, it means you have read, understood, and agreed to be bound by this Agreement.

1. ELIGIBILITY

You must have the legal capacity to enter into this Agreement. By agreeing to this Terms, you represent and warrant to us that: (a) you are not a minor under the age of 16 ( if you are located in EU, at least 13 years of age); (b) you have not previously been suspended or removed from the Site; and (c) your access to the Site is in compliance with all applicable laws and regulations. If you are accessing the Site on behalf of an entity, organization, or company, you represent and warrant that you have obtained the authority to bind that organization to these Terms and you agree to be bound by these Terms on behalf of that organization.

2. ACCOUNTS AND REGISTRATION

To access certain features of the Site, you may be required register for a User Account(by creating a Anycubic or Makeronline account ). When you register for a user account, you will be required to provide us with some information about yourself, such as your email address or other contact information. You represent and warrant that the information you provided is accurate and that you will keep it accurate and up-to-date at all times. When you register, you will set a password. Makeronline will not ask you to provide your account or password at any time, you shall keep your account and password safe. You are solely responsible for maintaining the confidentiality of your user account and password, Makeronline will no bear any responsibilities for the illegal use of your account or password due to your proactive disclosure or negligence in custody, hacking, internet fraud and so on, you shall seek compensation form the infringer through judicial or other remedies. You shall be responsible for all activities that occur under your user account.The User also agrees not to license, sell, or transfer your User Account without our prior written approval. The User Account you set up shall not violate all the applicable laws and regulations, otherwise Makeronline may suspend the use of your account or cancel it.

3. USER CONTENT

3.1 The User may upload and publish information and content with the user account to the Site, including 3D models files,print files,messages, reviews, photos, video, images, folders, data, text, and other types of works (“User Content”) and to publish User Content on the Site. You represent and warrant that you have the relevant legal rights to the User Content you release.

3.2 You are solely responsible for your User Content and the consequences of posting or publishing User Content. By posting or publishing User Content, you affirm, represent, and warrant that: your User Content, and the use of your User Content as contemplated by these Terms, does not and will not: (i) infringe, violate, or misappropriate any rights of any third-party, including but no limited, any copyright, trademark, patent, trade secret, moral right, privacy right, right of publicity, or any other intellectual property or proprietary right; (ii) slander, defame, libel, or invade the right of privacy, publicity or other property rights of any other person; or (iii) cause Makeronline to violate any laws or regulations or incurred damages.

3.3 You understand and agree that User Content is created and/or published by Users of the Services. The User Content is in no way inspected, tested, or otherwise quality controlled by Makeronline. Hence, the content may contain factual, technical and formal inaccuracies or errors and therefore may in no way be deemed to be expert advice or statements. Makeronline does not guarantee the quality or flawlessness of the user content and will not be liable to the User for any damages incurred as a result of using them.

3.4 Any and all reports and complaints concerning defective or unauthorised content, may be notified to Makeronline via e-mail address support@makeronline.com or reported using the “REPORT” button.

3.5 Makeronline does not serve as data storage. Also Makeronline does not guarantee to the User that the User Content will not be damaged, modified or deleted. MakerWorld has no responsibility or liability for the deletion, failure to store, or security of any User Content, including your User Content, and shall not be liable to the User for any damage incurred as a result of the loss of uploaded data including, but not limited to, User Content.

3.6 Disclaimer with respect to User Content:

We are under no obligation to edit or control User Content that you or other users post or publish, and will not be in any way responsible or liable for User Content. Makeronline may, however, at any time and without prior notice, screen, remove, edit, or block any User Content that in our sole judgment violates these Terms or is otherwise objectionable. You understand that when accessing the Site you will be exposed to User Content from a variety of sources and acknowledge that User Content may be inaccurate, offensive, indecent, or objectionable. You agree to waive, and do waive, any legal or equitable right or remedy you have or may have against Makeronline with respect to User Content. We expressly disclaim any and all liability in connection with User Content. If notified by a user or content owner that User Content allegedly does not conform to these Terms, we may investigate the allegation and determine in our sole discretion whether to remove the User Content, which we reserve the right to do at any time and without notice. For clarity, Makeronline does not permit copyright-infringing activities on the Site.

4. PROHIBITED CONDUCT

Use of Website and/or Mobile App.You represent and warrant than you will not use our website and/or mobile app, including but no limited:

(1) In any way that violates any applicable laws or regulations, including domestic, international.

(2) To engage in any conduct that restricts or inhibits anyone's use or enjoyment of our website and/or mobile app, or which, as determined by us, may harm us or users of our website and/or mobile app or expose them to liability.

(3)To upload, post, email, transmit, or otherwise make available any content that is harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable.

(4) To upload, post, email, transmit, or otherwise make available any unsolicited or unauthorized advertising or promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation.

(5) Violate, or encourage others to violate, any right of a third party, including by infringing or misappropriating any third party intellectual property right or violating any third party’s right to privacy;

(6) Interfere with the operation of the Site or any user’s enjoyment of the Site, including by: (a) uploading or otherwise disseminating any virus, adware, spyware, worm, or other malicious code; (b) making any unsolicited offer or advertisement to another user of the Site; (c) attempting to collect personal information about another user or third party without consent; or (d) interfering with or disrupting any network, equipment, or server connected to or used to provide the Site, or violating any regulation, policy, or procedure of any such network, equipment, or server;

(7) Bypass any security or other features of the Site designed to control the manner in which the Site is used, harvest or mine User Content from the Site, or otherwise access or access the Site in a manner inconsistent with individual human usage;

(8) Use any robot, spambot, spider, crawler, scraper or other automated means or interface not provided by us to access the Site or to extract data;

5. TERMINATION OF USE; DISCONTINUATION AND MODIFICATION OF THE SITE

5.1 In the event of breach of these Makeronline Terms and Conditions, generally binding legal regulations or good morals by the User, or even in case of mere justified suspicion of such a breach, Makeronline reserves the right to restrict the User’s access to Makeronline or other Makeronline services and to adjust the value of that User Account, or to suspend or completely cancel the User’s account without prior notice or any compensation.

5.2 Makeronline reserves the right that the Makeronline services may not be always available, especially as a result of a technical failure or scheduled maintenance. We further reserves the right to modify the services or to cease providing them at any time. We will not be liable for any damage incurred by the User as a result of unavailability, modifications or termination of provision of the services. To the extent permissible under the applicable legal regulations, the services are provided without any warranty.

5.3 We reserve the right, at our discretion, to renew or change these Terms on a going-forward basis from time to time. Please check these Terms periodically for changes. Modified versions of these Terms are effective upon their publication. If we make material changes to the Terms, we will attempt to provide you reasonable notice before such changes become effective. By continuing to access the Site, you agree to be bound by the updated, amended, or modified Terms. If you do not agree to be bound by the modified Terms, you must immediately cease your access to or use of the Site. Disputes arising under these Terms will be resolved in accordance with the version of these Terms that was in effect at the time the dispute arose.

6. LIMITATION OF LIABILITY

6.1 Makeronline assumes no responsibility, nor will be liable, for any damages to, or any viruses or malware that may infect the user's computer, telecommunication equipment, or other property caused by or arising from the user's access to, use of, or browsing the services, or the user's downloading of any information or materials from the services.

6.2 In no event shall Makeronline(and/or any Makeronline entity) be liable to the user or any third party for any lost profit or any indirect, consequential, exemplary, incidental, special, or punitive damages arising from or relating to these terms of use or the user's use of, or inability to use, Makeronline or services or third-party sites or apis even if Makeronline has been advised of the possibility of such damages. access to, and use of, Makeronline and services and apis and other content are at the user's own discretion and risk, and the user will be solely responsible for any damage to the user's computer system or loss of data resulting therefrom.

7. Governing Law and Venue

This agreement shall be governed by and construed in accordance with the laws of People’s Republic of China, without giving effect to any principles of conflicts of law. Any dispute or claim arsing out of this Agreement and you use of our service will be governed by Chinese Law. In the event that any provision of this Agreement is held by a court or jurisdiction to be invalid or unenforceable, the other provisions shall remain in force.
